Terms of Service

Please read these terms before using Lumiritz. By creating an account you agree to them on behalf of yourself and any child profiles you set up. If something is unclear, email us at care@lumiritz.com — we are happy to explain.
Early access. Lumiritz is currently in early access. Some features described here may be introduced gradually. We will update these terms as the service evolves and notify you of any material changes.

1. Who We Are and What These Terms Cover

Lumiritz is a learning system for homeschoolers ("Service"). In these Terms, "Lumiritz", "we", "us", and "our" refer to the Lumiritz service and team.

These Terms of Service ("Terms") form a legally binding agreement between you — the parent or guardian who creates an account — and Lumiritz. They govern your use of our app, website, and any related services.

A separate document, our Privacy Policy, explains how we collect and handle personal data. Both documents apply to your use of the Service.

2. Account Creation — Parents and Guardians Only

Accounts must be created by an adult. Children may not create their own accounts or agree to these Terms independently. If we discover that an account was created by a minor without parental involvement, we will suspend it and contact you.

To use Lumiritz, you must:

  • Be at least 18 years old (or the age of majority in your jurisdiction).
  • Be the parent or legal guardian of any child whose profile you create.
  • Provide accurate information when registering and keep it up to date.
  • Choose a strong password and keep your account credentials confidential.

You are responsible for everything that happens under your account — including any activity by the child using it. If you believe someone has accessed your account without permission, contact us immediately at care@lumiritz.com.

One account may support multiple child profiles, but each profile must belong to a child in your care. Sharing accounts across unrelated families is not permitted.

3. The Service We Provide

Lumiritz provides structured learning that adapts to each child's pace, interests, and progress. Features available during early access include:

  • Personalised learning sessions for your child.
  • Progress reports accessible to the parent account.
  • Access to our content library.
  • Customer support via email.

Additional features may be added over time. We will give you reasonable notice of any significant changes that affect the core learning experience.

4. Access and Payments

Early access

Lumiritz is currently offered in early access. Access terms — including whether early access is free, invite-only, or paid — are communicated at sign-up. Details of any paid plans will be shared directly with you before billing begins.

Paid plans (when introduced)

If and when a paid subscription is introduced, we will give you clear advance notice of pricing, billing frequency, and how to manage or cancel. Fees will be charged in advance at the start of each billing period, and you will be able to cancel at any time from your account settings.

Refunds

If you experience a significant failure on our side that prevents you from using the Service, contact us at care@lumiritz.com and we will assess a refund or credit on a case-by-case basis.

Price changes

We will give you at least 30 days' notice before introducing or increasing subscription pricing. Continuing to use the Service after a change takes effect means you accept the new terms.

5. Acceptable Use

What we ask of you

Lumiritz is designed to be a safe, focused learning environment. We ask all users — parents and children — to use it in that spirit.

You agree not to

  • Use the Service for any purpose that is unlawful or harmful.
  • Attempt to reverse-engineer, copy, or extract our AI models or proprietary content.
  • Introduce malware, bots, or automated scripts that could disrupt the Service.
  • Share your account credentials with people outside your immediate family.
  • Use the Service to generate, store, or distribute content that is inappropriate for children.
  • Misrepresent your identity or your relationship to the child using the Service.
  • Attempt to circumvent any content filters or safety guardrails we have in place.
  • Commercially exploit or resell access to the Service or its content.

Supervision

While we design Lumiritz to be safe for child use, we encourage parents to stay engaged with their child's learning journey — reviewing progress reports and discussing what they are exploring. Parental involvement amplifies the benefit of the Service.

Consequences of misuse

If we determine that your account is being used in violation of these Terms, we may suspend or terminate access. We will try to contact you first for minor issues.

6. Content and Data Ownership

What you own

Your child's learning data — their progress, session history, and any content they produce within the app — belongs to you. We are custodians of that data, not owners. You may request deletion at any time (see our Privacy Policy).

What we own

Lumiritz, its AI models, curriculum, visual design, lesson content, and all underlying technology are owned by us or our licensors and are protected by intellectual property law. These Terms do not grant you any right to copy, redistribute, or create derivative works from our content.

Feedback

If you share ideas, suggestions, or feedback with us, you give us permission to use them to improve the Service without any obligation to compensate you. We genuinely appreciate hearing from families.

AI-generated learning content

Responses and lessons generated by our AI during your child's sessions are produced for personal, non-commercial educational use. You may save or print them for your child's learning but may not republish or sell them.

7. Third-Party Services

The Service relies on carefully selected third-party providers including cloud hosting and AI infrastructure. We are responsible for our own Service; we are not responsible for failures or changes in those third-party services beyond our reasonable control.

Links to external websites within the app or our communications are provided for your convenience. We do not endorse or take responsibility for third-party content.

8. Availability and Changes to the Service

We work hard to keep Lumiritz available and running smoothly. However, we do not guarantee uninterrupted access. Scheduled maintenance, unexpected outages, or events outside our control may occasionally affect availability. We will communicate planned downtime in advance wherever possible.

We reserve the right to modify or discontinue features of the Service. If we discontinue the Service entirely, we will give you reasonable advance notice and handle any billing implications fairly.

9. No Warranties

Plain-English summary: We believe in Lumiritz and work hard to make it great, but we cannot promise it will be perfect, error-free, or always available. The clauses below reflect standard legal requirements for a software service.

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.

We specifically disclaim any implied warranties of:

  • Merchantability or fitness for a particular purpose.
  • Uninterrupted or error-free operation.
  • Accuracy or completeness of AI-generated content.
  • Results from using the Service meeting any specific educational outcome.

Nothing in these Terms limits your rights under mandatory consumer protection laws that apply in your jurisdiction and cannot be waived by contract.

10. Limitation of Liability

To the fullest extent permitted by law, Lumiritz's total liability to you for any claim arising from or related to the Service shall not exceed the amount you paid us in the three months immediately preceding the event giving rise to the claim. During free or early access periods, our liability is limited to the fullest extent permitted by applicable law.

We will not be liable for indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or loss of goodwill — even if we were advised of the possibility of such damages.

These limitations do not apply to: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless Lumiritz, its directors, employees, and partners from any claims, losses, or damages (including reasonable legal fees) arising from:

  • Your violation of these Terms.
  • Your use of the Service in a way that infringes a third party's rights.
  • Any content you submit to the Service that causes harm to a third party.

12. Termination

By you

You may stop using the Service and delete your account at any time. Deleting your account triggers the data deletion process described in our Privacy Policy. If you are on a paid plan, access continues until the end of the current billing period.

By us

We may suspend or terminate your account if you breach these Terms or if we are required to do so by law. We will notify you by email before taking action except in cases of serious or illegal misuse.

Effect of termination

On termination, your right to access the Service ends. Sections 6 (Ownership), 9 (No Warranties), 10 (Limitation of Liability), 13 (Governing Law), and any other provisions that by their nature should survive, will continue to apply.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

We hope that any concern can be resolved by contacting us directly at care@lumiritz.com. We will make a genuine effort to address your issue within 10 business days.

If a dispute cannot be resolved informally, it shall be subject to the jurisdiction of the competent courts in India. If you are a consumer in a jurisdiction that grants you the right to bring claims in your local courts, nothing here removes that right.

14. Changes to These Terms

We may update these Terms from time to time. For minor changes (fixing typos, clarifying language), we will update the "last updated" date. For material changes that affect your rights or obligations, we will notify you by email at least 14 days in advance and, where required, ask for your renewed acceptance before the changes take effect.

Continuing to use the Service after updated Terms take effect means you accept them. If you disagree, you may stop using the Service before the changes apply.

15. General

Entire agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Lumiritz regarding the Service, and supersede any prior discussions or agreements.

Severability

If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable. The rest of the Terms remain in full force.

No waiver

If we do not enforce a right or provision in these Terms on one occasion, that does not mean we have waived that right in the future.

Assignment

You may not transfer your account or these Terms to another person without our written consent. We may assign our rights and obligations — for example, in the event of a merger or acquisition — and will notify you if this happens in a way that materially affects your rights.

Language

These Terms are written in English. If they are translated into another language, the English version controls in the event of any conflict.
